Paradigm PCs – Terms and Conditions
Common terms used
‘We’ or ‘Us’ or ‘The Seller’ or ‘Paradigm PCs’ refers to Paradigm PCs Ltd
‘The buyer’ or ‘The customer’ refers to any legal entity purchasing from Paradigm PCs Ltd.
Conditions of Use
These Conditions of Use shall prevail over any terms contained in any order or offer made by the buyer or any document used by the buyer (which shall have no effect).
Ordering
When you order from Paradigm PCs you are making an offer to buy from us in accordance with these terms and conditions. Confirming your order or your payment does not amount to acceptance by us. Our acceptance occurs (and the contract is formed) only when the goods have been dispatched to the buyer. If the goods from one order are dispatched separately, then a separate contract is formed relative to each individual item or group of items dispatched together.
Order Process
The buyer may order products from us by completing and submitting an order through the checkout process on this website, or by special request by email. The buyer must provide all required information (including name, email address, contact phone number and payment details) or we may not be able to process the customers order.
Paradigm PCs (the sellers) discretion to reject an order
An order is not deemed to be accepted by us until we have sent the buyers order. Paradigm PCs reserves the right to accept or reject (for any reason) any order submitted by the buyer. If we reject the buyers order (or part of the order), any money paid by the buyer in relation to the rejected part of that order will be refunded and Paradigm PCs shall have no further liability to the buyer in relation to the rejected part of that order.
Prices
All prices on this website are shown in New Zealand dollars (NZD). Any currency conversion will take place online at the current exchange rate applicable at the time of purchase.
Taxes and other charges
All prices and delivery charges within New Zealand are inclusive of New Zealand Goods and Services Tax at the rate of 15%.
All orders qualify for free standard delivery when processed through the shopping cart.
A surcharge of 2% will be added at the shopping cart when paying by credit or debit card.
Overseas orders
We do not ship overseas.
Delivery
Once Paradigm PCs have confirmed acceptance of the buyer’s order, we will arrange to dispatch the buyer’s order within 1 business day unless a different time frame is specified. If Paradigm PCs are unable to dispatch the buyer’s order within the time frame specified we will endeavour to contact the buyer and advise the buyer of the expected dispatch date based on Paradigm PCs suppliers estimated time of arrival (ETA).
We reserve the right to dispatch the buyer’s order in one delivery or by installments. Paradigm PCs Failure to deliver any installment shall not entitle the buyer to cancel the contract for any items already delivered. The buyer may cancel any undelivered or backordered items except in special orders where Paradigm PCs have specified in writing that the backordered item can not be cancelled.
Any quotations of delivery times and ETAs by Paradigm PCs are made in good faith but are estimates and the seller shall not be bound by such quotation and we will not be liable for any loss, expense, or other damage caused by any delay in delivery.
The buyer may provide specific delivery instructions for an order but Paradigm PCs will not be responsible for any order that is delivered in accordance with the buyers delivery instructions. All orders are shipped on a signature required standard courier service. We use signature required courier tickets to safeguard us and the buyer in case of non-delivery.
Liability for shortages in the quantity of goods delivered is limited to making up the shortages. Where the buyer believes that there is a shortage in the quantity of products delivered, the buyer must notify us within 7 days of delivery and must provide a reasonable opportunity to investigate that claim.
Items should be adequately packed. Claims for damage or loss in transit must be made to Paradigm PCs within 7 days of receipt of consignment.
Prior to acknowledging delivery to the carrier the buyer must ensure that the complete consignment as per the carrier’s note has been received.
Should there be a shortage or visible damage to the outer packaging the carrier’s note must be endorsed accordingly.
No damage claims will be considered after 7 days of receipt of goods.
Cancellation of orders
Where products are listed on Paradigm PCs website with an incorrect price or with incorrect information, we reserve the right to cancel the buyers order (regardless of whether the buyer has made payment for that order). Where the buyer has already made payment for an order that is subsequently cancelled by us, we will refund the amount paid by the buyer in relation to that order.
Paradigm PCs may cancel the buyer’s order at any time prior to shipping. Any variation, waiver or cancellation of the buyer’s order shall have no effect unless accepted in writing by us.
Return of Goods for Credit or Refund
Goods supplied in accordance with the buyer’s order can only be returned with the express approval of Paradigm PCs.
General guidelines for product returns:
– Any product that has been opened or used cannot be returned.
– Unopened product will only be accepted back within 5 business days of purchase.
– Software cannot be returned.
– A $10 administration fee will apply to all non-faulty product returns.
– Any restocking fees charged to Paradigm PCs will be passed on to the customer.
Errors or Ommissions
Paradigm PCs is entitled at any time to correct all errors and omissions in any advertising, quotation, invoice or acknowledgement.
Description of Products
Modifications and improvements to Paradigm PCs products, prices and data on this website are constantly being made.
Although we endeavour to ensure that the product and pricing information provided on this website is accurate, complete, and current, Paradigm PCs does not provide any representations or warranties as to its accuracy, completeness or currency of information, and shall not be responsible or liable for any inaccurate, incomplete, or out-of-date information on this website.
Paradigm PCs also relies on information from its suppliers and product manufacturers and therefore the descriptions, illustrations and literature are not binding on the seller.
If the goods do not match the description on Paradigm PCs website, the buyer should inform us immediately so that we may take the appropriate action.
Ownership and Risk
Ownership of all goods sold by Paradigm PCs (“the goods”) is retained by Paradigm PCs until Paradigm PCs has received the full price for the products and any applicable delivery charges. This provision is designed to protect us in the event of bankruptcy, receivership or liquidation of the buyer, a seizure of goods by a creditor of the buyer or default in payment.
Until full payment is made the buyer agrees to:
Enable the goods to be readily identifiable as the property of Paradigm PCs.
Maintain the goods so supplied in good order and condition and to return the goods immediately if called upon to do so by Paradigm PCs.
On a sale or other realisation of the goods the buyer shall identify and separately account for the proceeds of sale.
Compliance
The buyer shall be solely responsible for obtaining any necessary permits under (and for compliance with) all legislation, regulations, by-laws and rules that apply to the use of any products you purchase from Paradigm PCs.
Force Majeure
Paradigm PCs shall not be liable to the buyer for any loss or damage, directly or indirectly arising out of or in connection with any delay in delivery of the goods, or failure to perform any term of this contract where such delay or failure is is outside the seller’s reasonable control.
Consumer Guarantees Act
If the customer is purchasing goods typically intended for personal, domestic, or household use, the customer may have specific rights under the Consumer Guarantees Act 1993 (CGA) that cannot be excluded or limited. These terms do not restrict or modify the customers rights under the Consumer Guarantees Act, except in circumstances allowed by the Act. If the customer is acquiring goods for trade or business purposes, the customer acknowledges that the provisions of the Consumer Guarantees Act 1993 do not apply to the supply of goods by the seller to the customer.
Changes to these Terms and Conditions
Paradigm PCs reserves the right to change these Terms and Conditions from time to time by publishing the changed terms on this website. When revised Terms and Conditions are published on this website, all orders submitted by the buyer after the revised Terms and Conditions are published shall be subject to the revised Terms and Conditions.
